Hello Nate, thank you for your inquiry. As far as a cargo van is concerned the answer to your question is yes and no. By that I mean technically according to the FMCSR (Federal Motor Carrier Safety Regulations) Section 390.5, a van
which has a GVW, GVWR or GVCWR gross 10,001 lbs or more or is used in the transportation of hazardous materials is considered a commercial vehicle. So if either of those conditions apply to your van you would be required to stop at scale houses which apply to all commercial vehicles but you would not have to enter those that say all trucks. Also relating to your question if you look in the FMCSR section 382.105 (which applies to controlled substance and alcohol use and
testing) and section 383.5 (which applies to Commercial Drivers License Standards and Requirements) you will see the definition of a commercial motor vehicle as: a motor vehicle or combination of motor vehicles used in commerce to transport passengers or property if the motor vehicle: a) Has a gross combination weight rating of 11,794 kg (26,001 lb.) or more inclusive of a towed unit with a gross vehicle weight rating of more than 4,536 kg (10,000); or b) Has a gross vehicle weight
rating of 11,794 kg (26,001 lbs) or more;or c) Is designed to transport 16 or more passengers, including the driver; or d) Is of any size and is used in the transportation of hazardous materials and which requires the motor vehicle to be placarded under the Hazard Materials Regulations (49 CFR part 172 subpart F). Since a cargo van is generally under 26,001 lbs you would not subject to hours of duty restrictions or logging unless you were hauling HazMat
requiring placards in which case you would need to have a CDL, would be subject to logging.
Of course there is one more concideration, the requirements of the company you lease to. Some companies, no matter what size vehicle you operate, require you to log,and have a class B CDL with HAZ Mat endorsement.
This probably sounds confusing because it is confusing. The best answer to give you is overall it depends on the company you lease with. As far as the DOT is concerned you can
